1. INTRODUCTION

These Terms of Service ("Terms") constitute a binding agreement between you ("User," "you," or "your") and Lemon.law, a California-based technology company ("Lemon.law," "we," "us," or "our"). These Terms govern your access to and use of the Lemon.law website, mobile application, and related services and their functionality (collectively, the "Service"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

2. NATURE OF THE SERVICE; NOT A LAW FIRM

2.1 Legal-Adjacent Technology

Lemon.law provides AI-powered tools, document-assembly features, intake and workflow support, repair-order analysis tools, and related technology to help users organize information relevant to potential lemon-law claims, make legal demands to manufacturers, and connect with qualified lemon lawyers as needed, including by managing your relationship with those to help improve the quality of service and value you receive.

2.2 Attorneys and Legal Advice

Lemon.law is not a law firm, does not provide legal advice, and does not represent consumers. Nothing on the Service constitutes legal advice, and your use of the Service does not create an attorney-client relationship except in connection with your engagement or intention to engage or obtain advice from a licensed attorney. All legal advice or representation will be provided exclusively by a licensed attorney sourced by lemon.law and with whom you choose to enter into an attorney engagement agreement. The attorney, not Lemon.law, is ultimately responsible for the quality of the attorney's services.

2.4 No Guarantees

Lemon.law does not guarantee any legal outcome, including whether your vehicle qualifies as a "lemon," whether a manufacturer will repurchase or replace your vehicle, or whether an attorney will accept your case.

3. USER RESPONSIBILITIES

3.1 Accurate Information

You agree to provide truthful, accurate, and complete information, including repair orders and service history documents.

3.2 Duty to Review

You understand that AI-generated content must be reviewed by a licensed attorney before being used in any legal context.

3.3 Compliance

You agree to comply with all applicable laws and these Terms.

4. AI-ASSISTED TOOLS; DISCLAIMERS

4.1 Limitations

AI-generated analyses, draft demand letters, and suggestions may contain errors, omissions, or inaccuracies. Lemon.law does not guarantee correctness, completeness, timeliness, or legal sufficiency.

4.2 Not Legal Advice

AI output is generated for purposes of making legal demands and supporting and facilitating the services of licensed attorneys only, and is not a substitute for legal advice from a licensed attorney.

4.3 User Responsibility

You are responsible for reviewing and verifying all AI-generated content, including any draft legal correspondence.

5. RELATIONSHIP WITH ATTORNEYS

5.1 Attorney-Client Relationship

Lemon.law does not provide legal advice, does not engage in the practice of law, and is not your attorney. However, to the extent your communications with us are intended to facilitate your legal representation by attorneys available through lemon.law, you and we agree that we are acting as your and/or their agents, to facilitate those legal engagements, and their work for you, such that your communications with us are confidential and subject to the attorney-client privilege.

5.2 Attorneys

Attorneys with whom you may be connected by lemon.law are independent third parties. Lemon.law is not responsible for their actions, omissions, deadlines, case strategies, or professional conduct.

5.3 Fees

Your obligation to pay fees to any attorney lemon.law may connect you with is governed by your agreement with that Attorney. Be sure to read it and ensure your qeustions are answered before you sign it.

6. PRIVACY & DATA PRACTICES

6.1 CCPA/CPRA Compliance

Lemon.law complies with the California Consumer Privacy Act and California Privacy Rights Act where applicable. Your rights may include the right to access, delete, correct, or limit the sale/share of personal data.

6.2 Data Collection

We may collect information you provide, including uploaded repair orders, contact information, case descriptions, and usage data, and use that information in connection with providing and improving the Service.

6.3 Data Sharing with Attorneys

By using the Service, you expressly consent to Lemon.law sharing your information, including repair orders and case information, with attorneys to facilitate your effort to obtain the repurchase or replacement of your vehicle by its manufacturer.

6.4 Third-Party Services

Lemon.law is not responsible for the privacy practices of attorneys or any third-party services used by attorneys.

7. LIMITATION OF LIABILITY

7.1 No Guarantee of Outcome

Lemon.law is not liable for any failure to achieve a vehicle buyback, replacement, settlement, or other legal remedy.

7.2 No Liability for Attorney Conduct

Lemon.law is not liable for any errors, omissions, negligence, malpractice, or misconduct by attorneys.

7.3 User-Provided Data

Lemon.law is not liable for inaccuracies, omissions, or defects in repair orders or other documents provided by the user.

7.4 AI Errors

Lemon.law is not liable for any damages arising from AI-generated errors, omissions, or misinterpretations.

7.5 Damages Cap

To the maximum extent permitted by law, Lemon.law's total liability for any claim arising from the Service shall not exceed the amount paid to Lemon.law by the User for the Service.

8. USER CONDUCT

You agree not to:

  • (a) misuse the Service or submit fraudulent claims;
  • (b) upload unlawful, defamatory, or infringing content;
  • (c) attempt to interfere with, disrupt, or undermine the Service;
  • (d) scrape, copy, or extract data from the Service.

9. INTELLECTUAL PROPERTY

9.1 Ownership

Lemon.law owns all rights, title, and interest in the Service, including software, AI systems, algorithms, text, graphics, interfaces, and related materials.

9.2 Limited License

You are granted a revocable, non-exclusive, non-transferable license to use the Service for your personal, non-commercial use.

10. BILLING & FEES

10.1 Fees to Consumers

Except as may otherwise be provided in a separate and additional agreement between lemon.law and you, and signed by you, the Service is free for consumers. We may receive fees from lawyers you enagage for provding them with data gathering, analysis, and work product including the preparation of demand letters, complaints, discovery, etc., as well as for introducing them to you as a qualified client.

10.2 Attorney Fees

Attorneys may charge legal fees under a separate agreement. Generally, attorneys will collect their fees only from manufacturers pursuant to applicable law. Lemon.law is not responsible for or involved in attorney billing.

11. DISPUTE RESOLUTION; ARBITRATION

11.1 Class Action Waiver

You waive any right to participate in class actions, class arbitrations, or representative proceedings.

11.2 Governing Law

California law governs these Terms.

11.3 Venue

Any permitted litigation shall occur exclusively in San Francisco County or Los Angeles County, California.

12. TERMINATION

12.1 Termination by Lemon.law

Lemon.law may suspend or terminate your account at any time for any reason, including misuse or violation of these Terms, or none.

12.2 User Termination

You may delete your account at any time.

13. CHANGES TO TERMS

Lemon.law may update these Terms from time to time. We will notify users by posting the updated Terms on the Service or sending an email. Continued use constitutes acceptance.

14. ACCESSIBILITY

Accessible versions of these Terms are available upon request in accordance with the Americans with Disabilities Act (ADA).
